These Terms of Service govern your use of clinchvalleydigital.com (the "Site"), operated by Kevin Bonilla, doing business as Clinch Valley Digital ("we," "us"), based in Tazewell, Tennessee. By using the Site, you agree to these Terms.
What this Site is
This Site is informational and promotional — it describes Clinch Valley Digital's web design, hosting, and IT support services and lets you get in touch. The Pricing page links to Stripe so you can start a monthly plan; Stripe processes those payments under its own terms, and each plan works as described on the Pricing page and in any written agreement we sign. Apart from those plans, the Site does not create a service agreement by itself. Any actual engagement for web design, hosting, or IT support is governed by whatever separate agreement, quote, or invoice is agreed to directly between you and Clinch Valley Digital — not by these Terms.
Jenna Lite (free download)
Jenna Lite is free, open-source software offered under the GNU General Public License v3.0 and downloaded from GitHub. It runs on your own computer, and Clinch Valley Digital does not receive your conversations, files or settings. As the license says, it is provided "as is," without warranty of any kind. You are responsible for the computer you run it on and for anything you choose to connect it to or send from it.
Accuracy of information
We try to keep the Site accurate, but portfolio descriptions, service details, and pricing mentioned informally are subject to change and are not a binding offer. Get current pricing and terms directly before engaging services.
Intellectual property
The design, code, and text of this Site belong to Clinch Valley Digital unless otherwise noted. Portfolio screenshots depict other businesses' websites, shown to illustrate work performed; those businesses retain rights to their own site content, branding, and trademarks.
Acceptable use
Don't use the contact form to send spam, attempt to compromise the Site's security, or submit anything unlawful, threatening, or fraudulent.
No warranty
The Site is provided "as is." We don't guarantee it will be error-free, uninterrupted, or perfectly secure, though we take reasonable steps toward all three.
Limitation of liability
To the fullest extent permitted by law, Clinch Valley Digital is not liable for any indirect, incidental, or consequential damages arising from your use of this Site. Our total liability for any claim arising from the Site itself is limited to the amount, if any, you paid us for the specific service giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
Changes to these Terms
If we materially change these Terms, we'll update the version and date at the top of this page.
